Close on the heels of the sub-divisional magistrate asking the police to investigate the thoroughly probe Sunanda Pushkar Tharoor's death, leading forensic experts have added a new twist to it.

According to leading independent forensic expert, Dr K.L. Sharma, "A person of her weight need to consume more than 225 tablets to cause death."

Dr N.P.Singh, Professor, Medicine, said, "It is unlikely that overdose could cause death... people survive even if a patient takes 100 times more dosage and it is unlikely that a person would die despite systemic lupus erythematosis." ( Also Read: Autopsy says Sunanda Pushkar died of a drug overdose, no clean chit to Shashi Tharoor yet )
The experts also say that it needs to ascertained as to whether Sunanda was taking the medicine on the doctors' prescription of on her own. They say that histopathologic tests must be conducted to ascertain the exact cause of her death. The police had earlier found some used strips of Alprax inside the hotel room where Sunanda Pushkar had been found dead.

Doctors say in most cases patients with such overdose survive if rushed to hospital in time. Unfortunately in Sunanda’s case, sources say rigor mortis had set in the body by the time it was taken to the hospital.

Earlier, in their autopsy report,AIIMS forensic experts had said that Sunanda died of poisoning, but had shied away from clarifying what kind of poisoning. They also said that her body had injury marks but, again, had not specified what kind of injury marks were seen on her body during the autopsy. Experts say that only the viscera examination might not be enough to ascertain how she died of poisoning. They say that an incomplete autopsy will be futile and unless histopathology is done it will be difficult to find out how she died. This examination will ascertain her exact cause of death... what kind of poision was there... Did her body react adversely to any medicine due to some inherent ailment or not.

Based on the autopsy report, the SDM who is investigating Sunanda Pushkar's death, has asked the police to inquire whether her death due to poisoning was accidental, suicidal or homicidal.

Meanwhile, many unanswered questions are doing the rounds, primary among them is how exactly did Sunanda die? Tharoor himself has demanded a speedy investigation. Until the investigation is not complete, the Tharoors and their friends will not get answers to these questions.

Minister of State for Human Resource Development (HRD) Shashi Tharoor has been given a clean chit in his wife Sunanda Pushkar's death probe.
The autopsy report of Sunanda Pushkar was given to the Sub-Divisional Magistrate Alok Sharma by All India Institute of Medical Sciences (AIIMS) stating drug overdose may have caused her death.
According to media reports, Delhi Police have said that Tharoor has been given a clean chit based on the testimony of a witness who saw Pushkar alive two hours after Tharoor had left the five-star hotel in Delhi where she found dead.
The physical injuries found on Mrs Tharoor's body were unrelated to her death.
Sunanda, 52, was found dead in her hotel room in Leela Palace in New Delhi's Chanakyapuri on Friday.
As the marriage of Sunanda Pushkar and Shashi Tharoor was over three years, the inquest proceeding into her death was overseen by the sub divisional magistrate.
Tharoor was questioned about his alleged relationship with Pakistani journalist Mehr Tarar.
Tharoor also wrote a letter to Union Home Minister Sushil Kumar Shinde, saying that he was "horrified" to read the "reckless speculations" over the matter in the media. Promising full cooperation in the probe, he urged the minister to instruct for a speedy investigation for the truth to come out at the earliest.
The entire saga revolving around the couple's life was played out on Twitter last week when Sunanda accused Tarar of attempting to break her marriage and declared her to be an ISI agent.
It finally took an ugly turn on January 17 evening, when Sunanda's dead body was found in Romm No.345 of the Hotel Leela Palace in New Delhi.
Sunanda's final rites were performed at the Lodhi Road crematorium on Saturday afternoon.

New Delhi: Supreme Court on Tuesday said that there cannot be any distinction whether a person on death row was convicted on charges of terror or otherwise in entertaining their petition challenging the rejection of their mercy petition on grounds of inordinate, unexplained and unreasonable delay by the president.
The apex court constitution bench headed by Chief Justice PSathasivam said that the president and the governor, while deciding mercy petitions were not exercising any prerogative but were discharging their constitutional obligation and even a death row convict has a de factor right.
Saying so, the court said that it did not agree with the decision of its another bench which declined to give relief to Devinder Pal Singh Bhullar on the grounds of inordinate delay in the execution of his mercy petition as he was convicted for committing terror.
In another landmark decision that will ensure that there was no repeat of Afzal Guru like execution, the court said that there has to be 14 days gap between the communication of rejection of mercy petition to the convict and his family members and actual execution of the death sentence.
The court said these 14 days are necessary for the convict to come to terms with the reality, to make peace with God, to execute his will and also have the opportunity to meet his family members for the last time.

Islamabad: Peeved at being at the centre of controversy surrounding Shashi Tharoor, Pakistani journalist Mehr Tarar claimed she had no role in his marital discord with Sunanda Pushkar and was a “victim of conspiracy”.
Tarar, who has changed her profile picture on Twitter to a burning candle following Pushkar’s death on Friday, said she met Tharoor twice – once in India in April and then in Dubai in June last year.
“There were lot of people present there,” the 45-year-old Lahore-based journalist said while speaking to Geo Tez last night.

“When I wrote an article that mentioned him, his wife probably did not like that another woman whom she did not know praised him so much. So she asked him to stop talking to me.
“Despite that he (Tharoor) kept following me on Twitter after which she said stop following her (Tarar) on Twitter.
“I don’t know why she had a problem about me talking to her husband over phone or email. The talks I had with him is something that I can talk with anyone and anywhere in the world,” she said. Tarar, mother of a 13-year-old boy, then surprisingly went on an all out attack on Pushkar.

“‘Fairytale is over’ News has been appearing about their marriage for long.” She said Pushkar first attacked her after an interview she did with Jammu and Kashmir Chief Minister Omar Abdullah. “She (Pushkar) tweeted saying why has our CM spoken to a Pakistani journalist. First Pakistan sends Army and then sends journalist. She started fighting with me,” Tarar said. She claimed she was a “victim of conspiracy”.
“Everything has happened to me. A Pakistani woman sitting here cannot spoil their marriage,” she said. Tarar alleged Pushkar always had one issue or the other. “She used to get upset and come on twitter. She has not been well for a long time. Some Indian Union Minister also said she was seriously ill. Her husband and his office have said she had been on medication for the last three days.
“She was not eating. She was smoking too much... She also had stomach TB. This is not what I am saying but what has appeared in Indian media. If she fights with her husband and later her health gets affected, what is the connection of the love story about me,” Tarar said.
52-year-old Pushkar was found dead at a five-star hotel in New Delhi. Pushkar and Tharoor were at the centre of a raging controversy when reports emerged that she was upset over reported text and tweet messages between her husband and Tarar.

Divorce is a last resort to Indian women. Most of the Indian society and religion are not encouraging    divorce . It is still considered as taboo in several societies.
For the sake of the kids future , belief ,social security, false pride,  Married women continue an abused relation. They behave like a happily married life .
Domestic Violence act also in place here for several years  with little impact.
The women who are difficult condition need emotional  help .
In most cases , it will not happen.  They usually take the path of suicide.
Suicide with kids are also make headline in several times.

What are the solutions ?

1) The government  can start or facilitate family helping online counselling centre.
2) Start a family mental heath audit by the help of NGOs and local bodies.
3) Provide social ,physical and emotional support to the needy  family.


Conclusion

A healthy family is the foundation of a healthy country. Happiness of the family is the happiness of the country. Make some laws and leave the issue is not a good model for a good governance .National women commission can do very crucial role in formulation and initiating thin kind of movement. Otherwise, "Happily married" claim will continue like a diplomatic lie for coming years.

New Delhi: Sunanda Pushkar Tharoor, the wife of Minister of State for Human Resources Shashi Tharoor, was found dead under mysterious circumstances in a city hotel room on Friday night, stoking renewed speculation over their relationship barely 24 hours after the two declared they were "happily married" following public airing of tweets that hinted about an extra-marital relationship and alleged involvement of a Pakistani woman.
Sunanda Tharooor, 52, was found dead on a bed in suite 345 at The Leela Palace hotel in south Delhi. She is survived by Tharoor, 57, and her 21-year-old son.
She had checked into the hotel Thursday night with her husband.

According to police, between 8-8.30 pm. Tharoor entered his hotel room no 345. He found that the main hall of the suite was open but her bedroom was locked from inside. Tharoor, who had attended the All Indian Congress Committee (AICC) session in the morning and a meeting in the evening in the suite, took the help of a "swipe card" to open the room, said police.
He called the hotel staff to open the room and found her lying on the bed. She was dressed in a nightgown and had a quilt over her. The minister's aides called the police, who arrived at 9.15 pm.
Tharoor's aide, Abhinav Kumar, told the media that Pushkar was found dead at 8.30 pm. and there was "no sign of foul play".
Kumar said: "We will not be able to give you the definite cause of death. There was no sign of foul play, no poisoning."

The couple had checked in to the hotel on Thursday morning as their house was getting painted, said Kumar.
For Tharoor, a Congress MP from Thiruvananthapuram, and Pushkar it was their third marriage. Her son is from an earlier marriage.
On Thursday, Tharoor and Pushkar issued a joint statement saying they were distressed by an "unseemly controversy" over some "unauthorized tweets" posted from their Twitter accounts and that both were "happily married and intend to remain that way".
The statement claimed that "distorted accounts" of comments "allegedly made by Sunanda", alleging an affair between her husband and a Pakistani journalist Mehr Tarar had "led to some erroneous conclusions".
"We wish to stress that we are happily married and intend to remain that way."
Tarar, who had attacked Pushkar on twitter, expressed shock at the death.
"I am absolutely shocked," Tarar said in a tweet. "This is too awful for words. So tragic, I don't know what to say. Rest in peace, Sunanda."
A magisterial inquiry is being conducted into Pushkar's death as the marriage was not yet seven years old, police said. Pushkar, who was not well, according to her own tweets, had got herself examined at the Kerala Institute of Medical Sciences (KIMS). In one of her last tweets Thursday, she posted in reply to a friend's query about her illness: "I'll try, got so many issues diagnosed in KIMS that now who knows when I got 2 go with joy Hastay hua jayegay."

Ishaan Tharoor, the minister's son, tweeted: "I would request that everyone please respect our family's privacy at this moment."
The twitter scandal erupted Wednesday after tweets posted on Tharoor's account reportedly spoke of his love for Tarar, who denied she was having an affair with the Indian minister.
Pushkar accused Tarar of pursuing her husband and threatened to divorce Tharoor. The journalist denied the allegation, and publicly trashed Pushkar.
In an interview to Economic Times, Pushkar said in reaction to the twitter war: “I took upon myself the crimes of this man during IPL (Indian Premier League). I will not allow this to be done to me. I just can't tolerate this. I have nothing more to say."

    New Delhi: A 51-year-old Danish tourist was robbed and raped at knife point by eight "vagabonds" near the New Delhi railway station on Tuesday, police said. Two men were arrested on Wednesday and some of the stolen belongings recovered.
    Police said Mohd. Raja, 22, from Fatehpur in Uttar Pradesh and Mahendra alias Ganja, 25, hailing from Maharashtra were arrested from near the Shivaji Park in central Delhi on Wednesday evening.
    Police recovered the woman's iPod, earplugs, spectacle case along with a mobile phone valued at Rs 1,200, bought from the looted money and Rs 1,800 in cash from the duo. Six accused are still at large.
    The woman who came to India on Jan 1, had gone to visit the National Museum on Tuesday but lost her way back to her hotel in Paharganj, a tourist hub in the heart of Delhi. She had returned to Delhi on Monday after visiting Agra in Uttar Pradesh.
    When she reached Paharganj by auto and asked for the way to her hotel, at around 4 pm, a group of men lured her to an isolated spot where they robbed her of her iPod and cash and then raped her at knife point, police said.
    In her police complaint, the woman said the men had slapped and hit her.
    She was held captive for more than three hours and managed to reach her hotel around 7 pm.
    A police officer told IANS the woman was "highly traumatised" when she reached the police station.
    "She had bruises on her face and neck. The manager of her hotel called the police around 9.30 pm.
    "From her description, the accused were all vagabonds," police said.
    The woman took the police to an area near the Divisional Railway Officers' Club close to the New Delhi Railway Station which she described as the place where the incident took place. But some doubts remain as to the exact spot of the crime.
    Around 30 men were detained for questioning, the police said.
    Police said the woman refused to undergo a medical examination. She opted to undergo the medical examination in her country, Denmark, and took a flight back home.
    On the basis of her statement, a case of rape and robbery was registered at the Paharganj police station.
    When the IANS correspondent went to the alleged spot of the incident, a large open garden area, an employee of the Divisional Railway Officers' Club said that a tent was being removed at the time of the rape, reported by the woman.
    "The Lohri festival was being celebrated on Tuesday night. Labourers were working inside the club premises and the garden. It is difficult to believe that a group of people took the woman into the garden and raped her," the employee said.
    He said the woman was probably confused about the spot.
    The Danish embassy, when contacted, said their foreign affairs ministry is aware of the incident but declined to give further details. "We can't share her personal details," an official said on Wednesday.
    Police said the woman had agreed to return to India to depose if required.
    This is the second such incident reported to the Delhi Police within a fortnight.
    A 33-year-old Polish woman was allegedly raped by a cab driver and abandoned near the Nizamuddin railway station on Jan 3. The woman was reportedly offered a lift by the driver when she was on her way to Delhi with her two year-old-daughter from Mathura in Uttar Pradesh, police said.
    The driver reportedly "sprayed something" on her face that made her lose consciousness. The woman realised she was assaulted sexually after finding herself on a bench outside the Nizamuddin Railway Station in south Delhi, with her daughter crying beside her.
    Delhi Chief Minister Arvind Kejriwal said he had met Lt. Governor Najeeb Jung on Wednesday and asked for a meeting with the police commissioner on why rape cases were increasing in Delhi.
    "We will hold a meeting with the Delhi police commissioner next week. He will be asked to come up with answers why the number of rapes has increased in Delhi. It needs to be analysed," Kejriwal said.
    The Delhi Police is not under the state government. It is under the central government.

    The Supreme Court on Wednesday issued notice on a plea filed by a law graduate seeking to put in place a permanent mechanism to attend the complaints of sexual harassment by both sitting and former judges at all levels, including the Supreme Court.

    The notice has been issued to the centre, Justice (Retd) Swatanter Kumar, secretary general Supreme Court, and Attorney General G.E. Vahanvati. Notice is returnable in four weeks by Feb 14.

    The apex bench headed by Chief Justice P. Sathasivam, while issuing the notice, made it clear that "at this moment we are not expressing any opinion on averments or allegations by the law graduate.


    The court said in view of the importance of the issue to evolve a permanent mechanism to address the complaints of sexual harassments by the judges at all level, the court appointed eminent counsel Fali Nariman and K.K. Venugopal as amicus curiae to assist the court.

    The court order came on a petition by a former law intern who alleged sexual harassment by former SC judge Swatanter Kumar.

    As per the new law the -Section 16- Prohibits the identity and address of the  aggrieved

    As per the law every complaint should be dealt with the internal committee of the institution with  a confidential manner.

    The law has been made as per the guidelines of Supreme Court .

    The sexual harassment allegations against the two supreme Court judges are very disappointing .

    Be hope that a sexual harassment prevention committee will be formed soon in the Supreme court and it will be dealt with as per the merit of the allegations in a confident manner.

    He won't go the Ganguly way. Former Supreme Court judge Swatanter Kumar has said he will prove that the sexual harassment allegations that an intern has made against him are a "sinister conspiracy" aimed at interfering with his functioning as the chairperson of the National Green Tribunal (NGT).

    A day before the Supreme Court is to hear the intern's plea for a probe into the allegations, senior lawyer Raian Karanjawala who Justice (Retd.) Kumar has engaged in his defence told Mail Today: "Tomorrow's hearing will be closely watched. In case the court issues notice, we will file a strong reply in the court on another day countering all the allegations point by point. We are ready to unravel everything and there will be many revelations. I'm not willing to go into the details at this point of time."

    That Justice (Retd.) Kumar has hired a senior lawyer to defend him unlike Justice (Retd.) A.K. Ganguly who was also accused of sexual impropriety with an intern and had to eventually step down as the chief of West Bengal Human Rights Commission shows he is willing to put up a fight. Justice (Retd.) Ganguly-who was not assisted by any lawyer- has alleged that he did not get a fair hearing before the three-member probe panel of Supreme Court judges that had looked into the allegations.

    "All allegations against my client are entirely false and concocted. My client has dealt with many important cases and the allegation is part of a deep-rooted conspiracy to adversely impact his handling of an extremely sensitive tribunal. It is a sinister conspiracy to besmirch the reputation of my client and interfere with him discharging his official duties," Karanjawala said.

    Sources said Justice (Retd) Kumar's old staff members are also preparing affidavits to testify that the intern's allegation of "unwelcome sexual behaviour" is false.

    One said nearly a dozen law clerks, interns and staff who worked at that time-between May 16 and May 28, 2011- with the judge are preparing affidavits to testify that there were always one or two persons present inside the judge's room and that it was impossible for such an incident to have happened.

    Raj Panjwani, President of the National Green Tribunal Bar Association which on January 11 passed a resolution that Justice (Retd.) Kumar was being "unjustifiably mob-lynched", said he fully agreed with the theory that there was a "deep-rooted conspiracy". " It cannot be ruled out. There were numerous instances of friction between the Ministry of Environment and Forests and the tribunal over suo-motu actions and various orders. His many environmental-friendly orders also rubbed numerous industrialists and businessmen the wrong way," said Panjwani.

    It is to be noted that Centre had on September 13, 2013 in an affidavit filed before the Supreme Court accused the National Green Tribunal of exceeding its brief and becoming a source of embarrassment for it in Parliament. The Centre had said the NGT had taken suo motu cognisance of many environmental issues without any jurisdiction and was creating hurdles for many projects.

    The intern has challenged the apex court's December 5, 2013 full court resolution in which it was decided that no complaint against retired judges will be entertained. She also submitted that a proper forum must be constituted to conduct an inquiry in such cases and that her complaint also be looked into by the apex court as in the case Justice (Retd.) Ganguly.

    The intern has named Justice Kumar, Secretary General of the Supreme Court, and Union of India as respondents in the case. She submitted that Justice Kumar was a sitting judge at the time of the alleged incident and the apex court must look into the complaint as per the Visakha guidelines to deal with complaints of sexual harassment at the workplace.

    The law intern filed the petition after the administrative side of the Supreme Court refused to entertain her complaint against Justice Kumar citing its full court resolution of December 5.

    The petitioner sought quashing of the resolution and setting up of a mechanism or forum to look into the complaints of sexual harassment.

    In Every work place ,sexual harassment accusation should be dealt with the sexual harassment act(prevention) which is enacted.
    There are generally three kind of sexual harassment accusations.
    1)  Genuine accusation.
    This type complaint is real which should be dealt the provisions of laws.
    2) Revenge Accusation.
    This false is accusation. To do a revenge or personal gain is the sole intention . In sexual harassment prevention act ( workplace ) has some provision to deal with the false accusation. However, the new amended criminal procedure code did not have that kind of provision.
    3) Psychological Accusation.
    This accusation is due to the illness of the person .A woman who is suffering paranoid
    schizophrenia can make sexual allegations as per the experience of the Psychiatrist. In this case both are victims. Only an experienced Psychiatrist can identify this type of accusations. They can behave like normal persons and they can describe the incident with all minute details including with time and  date in the believable ways. A south Indian famous psychiatrist wrote a  case experience last year in a  health magazine. ( With paranoid schizophrenia, ability to think and function in daily life may be better than with other types of schizophrenia.  Paranoid schizophrenia is a serious, lifelong condition that can lead to many complications, including suicidal behaviour)
     
    Identify the Genuineness of the Accusation is the main task. The right and identity of the victim and  accused  should be protected  at the investigating stage. The late complains should be dealt with separate category.
    Be hopeful that Supreme court with come with some reasonable guidelines to deal with

    NEW DELHI: The Supreme Court has found itself at the centre of a fresh sexual harassment controversy after one of its former judges, Swatanter Kumar, was accused by an intern of making sexual propositions while in office. Kumar, now retired, has vehemently denied the allegations.

    In an affidavit, the intern, then a student of West Bengal National University of Judicial Sciences who was interning with the judge in May-June 2011 and working out of his official residence on Delhi's Tughlaq Road, accused Kumar of inappropriate physical contact and also seeking to know if she was willing to travel with him and stay in hotel rooms.

    Kumar, who retired from the top court on December 12 and now heads the National Green Tribunal, called the accusations a conspiracy. "At least 20 interns have worked with me. They treat me like a father. These are totally false (allegations)... It is very unfair.

    The institution is being damaged and reputation of the judiciary being tarnished. It is some kind of a conspiracy," he told ET.

    But the intern in her affidavit, a copy of which is in ET's possession, said the judge had inappropriately touched her lower back on one occasion and kissed her on her shoulder on another, acts she termed "unwelcome physical contact and sexual advances".

    The latest revelations put an unflattering spotlight on the Supreme Court which has been rocked by allegations of sexual harassment against another of its judges, AK Ganguly, also levelled by an intern. As the court braces itself to ride out the latest storm, Additional Solicitor General Indira Jaising on Friday asked it to act against the former judge.

    Speaking on Times NOW, Jaising also announced the intern's intention to challenge the December 5, 2013, decision of the Supreme Court not to entertain any more complaints against retired judges.

    This decision was made by the Supreme Court after its three-judge committee named former judge AK Ganguly and concluded that he had indulged in "unwelcome conduct of a sexual nature" towards an intern.

    Jaising pointed out that any court decision on the administrative side can be challenged on the judicial side. The challenge is unprecedented because unlike Ganguly, who earlier this month was forced to step down as West Bengal Human Rights Commission chief, the fresh allegation is about an incident that occurred while the accused was a sitting judge.

    Ganguly had already retired from the Supreme Court when he is alleged to have made the unwelcome advances to the intern. Ganguly denies the accusations.

    But in the new case, the intern was on the Supreme Court roster and was not informally assisting the judge and experts believe the top court may not be able to cite lack of jurisdiction to deal with her complaint.

    "This is clearly sexual harassment at the workplace," said Jaising, who had also spearheaded the campaign for justice for the other intern who had leveled allegations against Justice Ganguly. Another SC judge Swatanter Kumar accused of sexual harassment "This is physical. It is a direct attack," she said. The Supreme Court itself had held that a similar incident of bottom-slapping a woman amounted to outraging the modesty of a woman and had convicted former Punjab cop KPS Gill.

    "You expect Supreme Court judges to know what the law is and the code of conduct and ethics to be followed. When you are in a position of power you don't take advantage of a 23-year-old," Jaising said.

    The top court, she said, had shown that it could do the honorable thing even if it involves its former brethren in Justice Ganguly's case. "I expect them to rise to the occasion. I would like the Supreme Court to reverse the December 5, 2013, decision," she added. She also said that the case would raise several important propositions of law, including what kind of behaviour was expected by judges towards women and whether the Vishakha guidelines apply to them or not.

    A great observation from the court. Every adult woman has the wisdom of  the consequence of the premarital sex. The religious concept of premarital sex is immoral. However, We live under the  Rule of law. People were ruled by religious laws in old days. Now , we  live in a democratic system.
    In a secular country , we people can keep religious belief or not.
    Now , live-in relationship is a fact which has legal backing also.

    The government should come with new law to deal with this social issue urgently.

    New Delhi: Premarital sex is "immoral" and against the "tenets of every religion", a Delhi court has said while holding that every act of sexual intercourse between two adults on the promise of marriage does not become rape.
    Additional sessions judge Virender Bhat also held that a woman, especially grown up, educated and office-going, who has sexual intercourse on the assurance of marriage does so "at her own peril".
    "In my opinion, every act of sexual intercourse between two adults on the assurance of promise of marriage does not become rape, if the assurance or promise is not fulfilled later on by the boy," the judge said.
    "When a grown up, educated and office-going woman subjects herself to sexual intercourse with a friend or colleague on the latter's promise that he would marry her, she does so at her own peril. She must be taken to understand the consequences of her act and must know that there is no guarantee that the boy would fulfil his promise.
    "He may or may not do so. She must understand that she is engaging in an act which not only is immoral but also against the tenets of every religion. No religion in the world allows premarital sex," the court said while acquitting an employee of a multinational company of the charges of rape.
    The 29-year-old man, a resident of Punjab, was arrested when a woman, doing a secretarial and administrative job at a private company in Delhi, lodged a complaint of rape against him in May 2011.
    In her complaint, the woman had alleged that the man, whom she had met through a chat website in July 2006, used to have physical relations with her on several occasions by promising to marry her.
