New Delhi: Newly elected Aam Aadmi Party (AAP) MLA from Seemapuri, Dharmendra Singh Koli, was on Monday booked on charges of molestation and rioting on a complaint by Congress worker Veer Singh Dhinghan who was defeated by him in the assembly elections, police said.
Koli, the party’s youngest MLA, refuted the charges, saying it was “a fake case” and “an attempt to malign my image”, while AAP said prima facie it seemed to be an attempt to malign the image of the party.
Supporters of the two parties clashed at around 11.30 am, when scores of AAP workers took out a victory procession in the area and started bursting crackers and celebrating in front of Dhinghan’s residence. Some of Dhingan’s supporters questioned their presence in the area and directed them to vacate the place, after which a clash ensued between the two camps, police said.
Police soon reached the spot and brought the situation under control. However, an FIR was registered late in the night.
“We have registered an FIR of molestation and rioting against Koli and others after a complaint from Dhingan and a statement by his wife that AAP members allegedly entered their house and misbehaved with her. Further investigations are on,” a police official said.
Reacting to the allegations, AAP said that prima facie it seemed to be an attempt to malign the image of the party.
“Also, it seems that it is a fake case as the incident happened in the morning and a complaint was filed late in the night. Koli will be expelled from the party if the allegations are found true but a defamation suit will be filed if they turn out to be false,” AAP said in a statement.
Refuting the charges, Koli said it was “a fake case as Congress is unable to accept their defeat”. “I will file a defamation case against them,” he said.
Defending himself, he said, “I was busy throughout the day in the procession. Our procession passed through Seemapuri, Gopulpuri and other parts of the constituency. I was in an open jeep and did not get time to get out of it. How can I do such things? It is an attempt to malign my image,” he said.

Question over Sanjay Dutt's parole, doctor says Maanyata ill

The law and rule without human touch are  absurd and outdated in the modern age.

Question over Sanjay Dutt's parole, doctor says Maanyata ill

Nagpur/Mumbai, Dec 7 (IANS) Uncertainty loomed over the fresh parole granted to imprisoned Bollywood actor Sanjay Dutt as the Maharashtra government Saturday sought a report on the issue while his wife Maanyata's doctor said she was suffering from heart and liver ailments.
The month's parole for Dutt on grounds that his wife was ill, apparently approved by the Pune divisional commissioner, has evoked strong reactions from various quarters.
A group of Republican Party of India (RPI) activists Saturday demonstrated outside the Yerawada Central Jail, protesting the actor's likely release.
Waving black flags and banners, RPI activists led by district chief Sandeep Sasane shouted slogans demanding that Dutt should not be granted parole and treated at par with other prisoners.
State Home Minister R.R. Patil has sought a report from the concerned departments to ascertain whether Dutt was eligible for a month's parole.
An official in Nagpur said police may also try to verify the nature of Maanyata's illness before a final decision on the parole is taken.
Political sources said the government was being extra careful in view of the winter session of the Maharashtra legislature starting in Nagpur Monday where the issue could be raised by the opposition.
In Mumbai, Maanyata's doctor said a tumourous growth in her body was "causing concern".
"She has complained of chest pain and sudden weight loss. During tests we detected a large tumour growth on her liver," her cardiologist Ajay Chaughule told IANS.
"Maanyata is also suffering from irregular heart beats and the tumourous growth is also causing concern," said Chaughule who is attached with Global Hospital, Mumbai, and specialises in heart and liver problems.
Asked whether the condition was serious, he declined to comment, but expressed hope that she would recover.
Though she had been advised to consider an angiography, Manyata opted for a second opinion with Chaughule.
Dutt, 54, had recently applied for a month's parole saying he wanted to take care of his sick wife.
However, Maanyata reportedly attended a film premiere Thursday night and her pictures were splashed in various online media. She was seen sporting jeans and T-shirt.
This would be the third time Dutt will be granted parole in the past three months.
Dutt was granted the first parole for a fortnight due to medical reasons Oct 1, which was extended by another 15 days and he returned to the jail Oct 30.
The actor is presently serving the remaining 42 months of his five-year sentence for his involvement in the March 1993 Mumbai serial blasts.
Having served 18 months in jail before his trial began, Dutt started his stint in the jail May 16. In prison, he has been assigned the task of making paper bags which are sold outside through some NGOs.
Though Dutt spent Diwali in jail along with other inmates, he is likely to enjoy Christmas and New Year with his family if he gets parole now.

Ladies' gang uses molest trap for cash

Such incidents have been reported over the past few weeks but no one had dared go to police until the all-lady gang targeted a lawyer.
Times of India
KOLKATA: If you are a pedestrian or use the public transport system, beware of a gang of women that traps innocent people as molesters and extorts them.

At a time when sexual harassment cases are shaking the nation, this bunch of women has seized upon the fear psychosis to make some quick money, regardless of what effect it might have on women who are actually victims of molestation and rape.

Such incidents have been reported over the past few weeks but no one had dared go to police until the all-lady gang targeted a lawyer on Wednesday, without realizing his wife was with him or that there were legal clerks around as witnesses.

Lawyer Asim Kumar Maity was returning home when the incident occurred in the busy Dalhousie area.

"It was around 5.30 pm, after the day's work. I, my wife and some law-clerks were looking for a taxi in front of Mughal Garden Restaurant. My wife was a little away chatting with the law clerks. I had just had an altercation with a cabby over refusal. All of sudden, a woman, who looked to be in her late 40s, swung towards me and held me by my collar. I was stunned. I had never even dreamt of being in such a situation," recounted Maity.

The woman charged Maity aggressively and accused him of molesting her. "Why did you touch me," she demanded to know and threatened to "drag him to Hare Street police station".

The commotion quickly attracted a crowd. And as it happens in such cases, people instinctively trust the woman.

"She was hurling filthy abuses to unnerve my husband. In no time, three other women emerged from a nearby alley and joined the first one. By the time I had overcome my initial bafflement and rushed to rescue my husband," said Kaberi Sengupta Maity.

Maity, too, had shaken off his initial shock and shouted back. That his wife was with him gave him added support.

"They were not only abusive but were threatening to put me behind bars. When my wife came to my rescue, they grew more desperate and tried to draw public sympathy by 'showing' how I molested her. From their words, my legal brain could pick up that they knew of Section 354-IPC (molestation) and that it had been made a non-bailable offence," Maity said.

The gang backed off only when they realized Maity was a lawyer and he not only had the support of his wife but a bunch of legal clerks as witnesses.

"Other lawyers also came to our rescue, so did law-clerks. I told them that I was ready to go to any police station and demanded to see their identity. They were still hurling abusive words. By then, a law-clerk brought a cab and we boarded it. The women banged on the taxi as we were about to leave," Maity said.

Since they were all women, Maity and his group decided not to confront them any further. "But later, I felt I must record a complaint as they can harass an unsuspecting citizen and extort him in the name of an out-of-police-station settlement. Police must be proactive to nab the gang before they trap others," he said. Hare Street police are investigating the complaint.

The women are aged between 38 and 50. There have been rumours of women suddenly accusing men of molestation and dragging them to police but stopping short of it and agreeing to "settle" it for cash. Maity is the only one to file a complaint so far.

Chandigarh: On the run for the past 58 days, Narayan Sai, son of spiritual guru Asaram Bapu who was wanted in connection with a sexual assault case, was arrested Wednesday, police sources said here.
The arrest, according to Punjab police sources, was made by a team of the Delhi and Gujarat Police early Wednesday. The exact location of his arrest was not known immediately.
The police teams, including a special investigation team (SIT), also arrested four accomplices of Narayan Sai who were helping him avoid arrest for nearly two months.

When Sexual Harrassment Accusation trurns Public lynching..

Views :  A former SC judge deserve some kind of dignity . The law intern made some remarks about the judge in a blog . The intention of the law intern was not make a legal issue  against the  judge.
She wrote on the blog that she don't like to spoil the reputation of the judge.
But , what is happened ? When the name of the judge has gone to public , where is the matter of reputation ? What is really happened in the hotel room ? Nobody knows. Who says the truth?
Nobody  knows. One thing sure .The reputation of the judge has gone already . In the eyes of the public ,he will be a  doubtful man till the end and after the death also.
When a sexual harassment accusation arises against somebody, his reputation will be gone at that moment. Whether , the accusation is false or true is immaterial. It is not fair and justice . The law permits to keep the name of the victim unknown. The same benefit should be given to the accused also till the crime is proved in the court .
This  kind of public  lynching  never serve purpose of  the law and justice.
Let the law intern  decide whether to go ahead with the accusation or not as she is a matured women and a lawyer.

New Delhi: Former Supreme Court judge Ashok Kumar Ganguly, accused of sexual harassment by a young woman law intern, on Tuesday said he was "undecided" on whether to resign from the chairmanship of West Bengal Human Rights Commission. "I have not decided. I am undecided," Ganguly said.
"Time has not come to think about it," he said when asked about his future course of action in view of demands for his resignation as the chairman of West Bengal Human Rights Commission (WBHRC) from certain quarters, while he has received support from some other sections.
BJP leader Sushma Swaraj had on Monday night demanded the resignation of Justice Ganguly, saying "not only Caesar's wife but Caesar too must be above suspicion".
Asked if Ganguly should step down from the postof chairman of WBHRC, former Chief Justice of India Altamas Kabir recently said, "One automatically does not resign on the basis of allegations. I know he had said that he was shocked and shattered. I never ever would believe that this is possible."
